Defective Product Injury FAQs

Here’s what you need to know if a product caused your injury.

  • What qualifies as a defective product?

Any product with a design flaw, manufacturing defect, or inadequate warnings that causes harm may qualify. We assess whether the product was unreasonably dangerous and not used improperly.

  • Do I need to keep the defective item?

Yes, if possible. Preserving the item can be critical to proving your claim. Even damaged products can provide important evidence of how and why the defect occurred.

  • Can I sue a retailer or seller?

Yes. In Illinois, sellers in the chain of distribution may also be liable, even if they didn’t make the product. We identify all potentially responsible parties.

  • What types of damages can I recover?

You may recover compensation for medical bills, lost wages, pain and suffering, future care, and—in some cases—punitive damages. We assess the full scope of your losses.

  • How long do I have to file a claim?

Illinois generally allows two years from the date of injury. The sooner you act, the better your chances of preserving evidence and building a strong case.
